Section 337 Litigation Associate (Remote)

A national law firm is seeking a Section 337 Litigation Associate to join its intellectual property litigation practice. This position may be based in any of the firm’s U.S. offices or through its fully remote virtual office.

The associate will work on high-stakes investigations before the U.S. International Trade Commission and will collaborate primarily with attorneys serving clients in the technology, manufacturing, and transportation sectors.

Responsibilities

  • Represent complainants and respondents in Section 337 investigations before the U.S. International Trade Commission
  • Draft complaints, responses, motions, discovery requests, claim-construction briefs, prehearing submissions, post-hearing briefs, and Commission review filings
  • Develop and analyze domestic-industry evidence
  • Work with technical and economic experts
  • Prepare witnesses and participate in depositions and evidentiary hearings
  • Advise clients regarding exclusion orders, cease-and-desist orders, enforcement, remedies, public-interest considerations, and related Customs proceedings
  • Manage multiple matters under the accelerated schedules common to ITC litigation
  • Communicate legal strategy and recommended courses of action to clients and internal teams

Qualifications

  • Preferably three to six years of legal experience
  • Participation in at least two Section 337 investigations
  • Strong familiarity with:
    • Domestic-industry requirements
    • ITC remedies and enforcement
    • The Commission’s Rules of Practice and Procedure
    • Discovery, hearing, and post-hearing procedures before the ITC
  • Knowledge of patent and intellectual property law
  • Technical or engineering degree is not required
  • Excellent academic credentials
  • Strong legal writing, analytical, project-management, and interpersonal skills
  • Ability to work effectively under pressure and manage competing deadlines
  • Active bar membership in the jurisdiction corresponding to the selected office, or willingness to obtain admission promptly

 

Candidates should be prepared to discuss the specific Section 337 matters on which they have worked, their individual responsibilities, and any evidentiary-hearing experience.

Location

The role may be based in any U.S. office or through the firm’s remote virtual office. Candidates must reside in the United States.

Compensation

The anticipated base salary range is $215,000 to $250,000 in California, Colorado, Illinois, Massachusetts, Maryland, Minnesota, New Jersey, New York, Vermont, Washington, and Washington, D.C.

Compensation in other markets will vary based on location, experience, qualifications, and applicable market data.

Associates are also eligible for performance and client-development bonuses.
